Prosecutors have appealed a judge’s ruling that acquitted a doctor of four counts of first-degree murder and negligence, saying a judge erred in not allowing evidence from key expert witnesses.

Filed in the Ontario Court of Appeal on July 30, the Crown is requesting a new trial for Dr. Brian Nadler, who was charged with four counts of first-degree murder and criminal negligence causing the deaths of Albert Poidinger, 89; Claire Brière, 80; Lorraine Lalande, 79; and Judith Lungulescu, 93 — all elderly patients at the Hawkesbury & District General Hospital in March 2021, where Nadler worked as an internal medicine specialist at the time.
